What Real Estate Developers should know about telecoms infra.

We are PDC Telco. A subsidiary of state-owned Penang Development Corporation (PDC), we are a designated State-Backed Company (SBC) under the Time-2 Programme for 3G Rollout, and we have been granted a Network Facility Provider (NFP) license by industry regulator, the Malaysian Multimedia and Communications Commission (MCMC).

To help future-proof Penang as a Knowledge-Economy state and usher in the Big Data Era, PDC Telco is now embarking on a fibre-optics-based Next Generation Network, scheduled to be fully operational state-wide by Quarter 4, 2014, which will provide state-wide trunk coverage, carrier-grade service quality and options for redundant routes for broadband services.


Industry Liberalisation

Our efforts have been made possible by the opening of the telecommunications sector. Unlike the power supply industry which supports a monopolistic player, the telecommunications industry in Malaysia has been liberalised since 1985, when Jabatan Telekom Malaysia (JTM) split into two branches. The commercial branch was corporatised as Syarikat Telekom Malaysia Berhad (STMB) and later evolved into Telekom Malaysia Berhad (TM), while the regulatory branch remained known as Jabatan Telekom Malaysia.

JTM’s regulatory function officially ceased on March 31, 1999 with the adoption of the Communications and Multimedia Act (CMA) in 1998, after which the Malaysian Communications and Multimedia Commission (MCMC) took over as the regulator for the entire telecommunications industry in Malaysia.

The CMA 1998 mandates a licensing system where all operators in the telecommunications and multimedia sectors are licensed under four major categories, namely Network Facility Provider (NFP), Network Services Provider (NSP), Content Applications Service Provider (CASP) and the class license category of Applications Service Provider (ASP).

Owing to this liberalised regulatory framework, the telecommunications industry has witnessed a dynamic change in service provisioning which promotes healthy competition and a more level playing field, while eradicating predatory dominance.

  TM no longer regulates

It is pertinent to highlight that, with the enforcement of CMA 1998, Telekom Malaysia became a mere peer among the other NSPs/ NFPs that consumers and end-users can choose from.

More importantly, TM is no longer the sole commercial company that local authorities and real-estate developers need to consult for the approval of development plans.

The liberalisation of the telecommunications sector in Malaysia has opened up the market, allowing for competition and resulting in greater benefits for end-users in terms of pricing and services. For investors and other players who wish to enter the market, an understanding of the various regulations governing activities in the sector is a must.

III. PDC Telco: The One-Stop Agency (OSA)

The state of Penang is embarking on the roll-out of the Penang Next Generation Network (NGN), and is welcoming industry players and services providers to partner it in its drive to bring high-bandwidth connectivity to businesses and residents.

As can be seen in this website, there are many standards, guidelines and regulations to which developers, service providers and other parties involved in delivering fibre-to-the-premise (FTTP) need to adhere to.

PDC Telco has been tasked by the State Government via Chief Minister’s Inc (CMI), to be the One-Stop Agency for such tasks as coordinating the issuance of trenching permits for civil engineering works and ensuring that workmanship by telecoms contractors abide by the strictest standards.

By extension, PDC Telco is also to implement a state-wide Telecommunications Common Trenching System. Our key role is to facilitate telecoms operators in meeting regulatory requirements, as well as to provide assistance with regards to network coverage areas and availability schedule, trenching specifications and architecture, dark fibre pricing, and backhaul wholesale bandwidth.
  This includes overseeing compliance to the Technical Code for Fibre-to-the-Premise, Guidelines for Underground Utility and Detection Mapping, and The Standard Operating Procedure for Fibre-Optics Telecommunications Trenching.

In strategic partnership with neutral NSP licensee as a neutral player in the provisioning of fibre-optic ducts within a Common Trenching System, dark fibre and backhaul bandwidth, PDC Telco assures industry players that we will not operate as a competitor in providing retail services.

Rather, we will be a partner in delivering carrier-class fibre-optics network facilities services to end users in Penang through the licensed NSP operators.

IV. Delivering Services

As a One-Stop Agency, PDC Telco is the main coordinator between telecom-munications industry players in Penang and relevant government agencies and technical departments.

We are involved from the pre-construction to post-construction stages; from before the project has started to the time it comes to renew the work permit, if necessary, for civil engineering works for the trenching.
  By alleviating the headache of handling bureaucratic matters from the industry players, PDC Telco gives them the opportunity to focus on their core competencies, that is to serve their end-user customers.

V. Pre-Construction

PDC Telco has been tasked with checking all relevant documents during the pre-construction stage of a project including 1st Stage applications for way leave approval and 2nd Stage applications for permit approvals.

For 1st Stage applications, we will help check, along with the Telco operator, the way leave checklist form from the appropriate municipal council, which is either the Majlis Perbandaran Pulau Pinang (MPPP – Penang Island Town Council) or the Majlis Perbandaran Seberang Perai (MPSP – Seberang Perai Town Council), as well from the Jabatan Kerja Raya (JKR – Public Works Department) in all districts.

All forms have to be complete and adhere to the relevant authorities’ requirements, and PDC Telco is authorised to reject incomplete applications on the spot.

We also have the responsibility of keeping records of applications, including making copies, recording and filing application documents. In accordance with the Guidelines for Underground Utility and Detection Mapping, PDC Telco will also upload, maintain and manage the underground utility data to a live repository hosted on Cloud Computing, before they are finally amalgamated with the National Underground Utility Database.

For this purpose, PDC Telco requires the applicants to provide detailed information, some could be in specific digital format, such as backhaul connectivity in the overall route-plan in order to eradicate the chaos of ad-hoc planning for trenching for single- operator use that totally negates the objective for the Common Trenching System.
  PDC Telco will also prepare covering letters, and submit applications to the relevant authorities. A carbon copy of the letter will be delivered to both the Telco operator for whom PDC Telco is making the application and also the Chief Minister Inc. We will also follow up with the authorities on the status of applications.

Upon receiving the consent letter for a 1st Stage application, PDC Telco has the responsibility to make a record of the consent, and to write a cover letter which will then be attached to the consent letter as part of the process for applying for 2nd Stage approval. The process of 2nd Stage application follows the same as 1st Stage application.

Once the permit has been received, we will call the Telco operator to collect the permit, as well as prepare the permit issuance letter and ensure that the operator signs the permit acceptance form.

After the granting of the permit, the Telco operator will need to provide us with a ‘Start of Work Notice’ at least 3 working days in advance, after which we will prepare the ‘Start of Work Notice’ and submit it to the relevant authorities. PDC Telco will also set the date of Site Kick-Off Meeting (SKOM), and conduct the SKOM.

VI. During Construction


During construction, PDC Telco will conduct regular onsite inspections to ensure that regulatory requirements are being complied with. We will also require the Telco operator to submit a weekly report containing updates on progress.

VII. Post-Construction


Once the project has been completed, the Telco operator has to submit an interim report to PDC Telco, which we will then record and file. If necessary, we will also apply for the renewal of permits.

The next step is to conduct the CBR/coring test. PDC Telco will inform the operator to set a test session date, and will inform and invite the relevant officials to the session. Our representatives will also be present during the session.
  After the session, we are to receive the test report, which will enable us to prepare a ‘Completion of Work’ notice and submit both documents to the authorities. This will enable the project to receive a ‘Certificate of Work Completion’.

With the ‘Certificate of Work Completion’, the deposit paid by the Telco operator will be refunded. To facilitate this, PDC Telco will prepare the covering letter to the authority, and attach it with the deposit receipt and ‘Certificate of Work Completion’. We will then receive the deposit and return it to the operator.

VIII. Permit Renewal

PDC Telco also facilitates the renewal of permits. To do so, the Telco operator has to submit the relevant documents – namely a covering letter and the Interim Report to justify the request, at least 3 days prior to the site visit. We will make copies of these, record and file all applications, and will reject any which are incomplete.

PDC Telco will forward the renewal applications to the relevant authorities, including preparing a covering letter, attach the original permit and approved plans to the letter, and deliver it, with a copy sent to the CMI and the operator applying for renewal.
  Once the renewal permit has been granted, we will make copies, as well as record and file the copied documents. PDC Telco will also prepare the permit issuance letter, and conduct the SKOM, when we will hand over the renewed permit and ensure that the operator signs the permit application form.

However, it is to be noted that renewal of expired permit for work uncompleted within the original stipulated time-frame is not automatic and it is reviewed on a case-by-case basis, to prevent abuse.
